Copyright & Licensing
Hempshall.Co retains full copyright ownership of all photography, videography, and media produced.
The booking agent or agency is granted a non-exclusive, non-transferable license to use the media for the sole purpose of marketing the specific property.
This license is valid until the property is successfully sold or let.
Media may not be sold, transferred, or gifted to third parties (including builders, interior designers, homeowners, or competing estate agents) without express written consent and additional licensing from Hempshall.Co.
Turnaround times & delivery
Photos, Floor Plans, & Social Media Video: Delivered within 48 hours of the shoot concluding (excluding Sundays and UK Bank Holidays).
High-End Video Production: Delivered within 5 working days of the shoot concluding.
All finished media will be delivered via a Google Drive link.
Payment Terms
To maintain a smooth workflow, an invoice will be issued to the booking agent upon the delivery of the first piece of completed media from the package.
Payment is strictly due within 14 days of the invoice date.
Cancellations & Rescheduling
We understand that vendors delay and properties fall through, but late cancellations drastically impact our driving routes and daily operations.
Cancellations or rescheduling requests made between 9 and 24 hours prior to the scheduled start time will incur a fee equal to 50% of the total booked package.
Cancellations made with less than 9 hours' notice (or a failure to access the property upon arrival) will incur a fee equal to 75% of the total booked package.
Property Readiness
The property must be clean, decluttered, and photo-ready prior to the scheduled start time.
The photographer will shoot the property "as-is." For liability reasons, our team cannot wait for cleaners, assist with heavy cleaning, or move vendors' furniture.
We are happy to offer grace for an agent running slightly behind schedule. However, if a vendor is entirely unready to the point where the shoot cannot take place, it will be treated as a same-day cancellation subject to the 75% fee.
Travel & Mileage
All packages include complimentary travel within a 25-mile radius of our base in Ackworth.
Properties located outside of this 25-mile radius will incur a standard travel fee of £0.50 per additional mile, unless otherwise agreed upon prior to booking.
Drone Restrictions
Drone flights are strictly dependent on safe UK weather conditions (no rain, no high winds) and local airspace restrictions (Civil Aviation Authority).
If weather prevents a safe flight on the day of the shoot, the interior ground shoot will proceed as normal, and the drone service will be either rescheduled or fully refunded.
If a property is located in restricted airspace that requires a commercial airspace unlock, an additional service charge may apply. Please check www.thedronemap.com for potential restrictions.
Weather & Reshoots
Where possible, we will perform standard "sky replacements" on exterior photos to provide a blue sky appearance at no extra charge.
If the weather is too severe to capture exteriors entirely, or if the agent specifically requests a secondary visit on a different day strictly to capture sunny exterior media, a standard Return Trip Fee of £50 plus standard mileage (£0.50/mile) will apply.
Twilight Photography
True twilight photography relies on a very strict 30-to-45-minute window of natural light. Photographers must begin shooting at the exact agreed-upon time. Delays caused by unready properties or late arrivals will result in missing the twilight window, and the shoot will still be billed.
Twilight shoots are heavily weather-dependent. If rain or severe weather prevents the twilight shoot, it will be rescheduled without penalty, or the agent may opt for a "Virtual Twilight" (day-to-dusk digital edit) alternative if applicable.
Re-edits, Re-shoots & Vendor Requests
Standard Editing: All packages include standard professional editing (colour correction, vertical straightening, and standard sky replacements), we will often remove unwanted items, however removal or change of fixed items such as cabinets or windows would fall under our virtual staging add on, and would be at the discretion of the booking agent.
Re-shoots (Vendor Preference): Our photographers shoot the property exactly as it is presented upon arrival. If a vendor or agent is unhappy with the final media because of the property's physical state (e.g., untidy rooms, unmade beds, vehicles on the drive, or unappealing furniture), any requested return visits to re-shoot will be billed as a new, full-priced booking.
Re-shoots (Technical Error): Complimentary re-shoots are strictly reserved for instances of technical failure on our end (e.g., equipment malfunction).
Re-edits: Complimentary re-edits are strictly reserved if either the vendor or agent are not satisfied with the post production. This excludes our 24hr turnaround add on and is only applicable if the media has not been used publicly to advertise. We, Hempshall.Co, reserve the right to not do complimentary re-edits.
AI & Property Misrepresentation
Standard Enhancements: Hempshall.Co utilises AI-assisted editing tools strictly for standard aesthetic enhancements, such as digital sky replacements, window masking, and general colour/lighting correction.
Altering Reality: We strictly prohibit the use of generative AI to alter the permanent physical reality of a property. We will not digitally remove permanent structures (e.g., power lines, neighbouring buildings, street signs) or hide structural defects (e.g., wall cracks, damp, or damaged flooring).
Virtual Staging & Edits: If an agent specifically requests "Virtual Staging," "Virtual Twilight," or the digital removal of temporary clutter (e.g., skips, vehicles, or personal items), it is the sole responsibility of the booking agent to disclose to potential buyers that these images have been digitally altered.
Liability: The booking agent assumes all legal liability for ensuring the final published media complies with any relevant property misdescription laws. Hempshall.Co accepts no liability for claims of misrepresentation arising from the use of our media.
Substitution & Subcontractors
Hempshall.Co reserves the right to substitute the primary photographer with another fully qualified and insured subcontractor or team member in the event of illness, emergency, or scheduling conflicts.
There may be dates when our core team is fully booked. In these instances, agents will be given the choice to either wait for our next available slot or utilise a photographer from our trusted subcontractor pool.
Strict Vetting: Our pool consists exclusively of active professional photographers from various commercial industries. Before shooting for our clients, every subcontractor is required to shadow a minimum of two properties under our direct guidance.
Confirmation: We do not require our subcontractors to disclose their ongoing availability. Instead, if an agent requests a subcontractor, the job is broadcast to the pool with a strict 2-hour response window. If no subcontractor accepts within 2 hours, the agent will be notified immediately so alternative arrangements can be made.
In-House Post-Production: To ensure our signature style and quality remain 100% consistent, subcontractors are responsible for capturing the raw media only. All editing, colour grading, and final delivery are processed strictly in-house by the Hempshall.Co core team.
By booking our services, the client (agent, agency, or vendor) agrees not to directly solicit, privately hire, or bypass Hempshall.Co to book any of our introduced subcontractors or team members for media services.
All bookings, scheduling communications, invoicing, and media delivery involving our subcontractors must be conducted strictly through Hempshall.Co.
Health, Safety & Pets
The safety of our team is paramount. If a photographer arrives at a property and deems the environment to be unsafe (e.g., severe structural hazards, biohazards, hostile individuals, or unsecured aggressive animals), they reserve the right to immediately terminate the shoot and leave the premises.
In the event a shoot is terminated due to unsafe working conditions, the agent will be billed the 75% same-day cancellation fee.
All pets must be secured, contained, or removed from the property during the shoot. Photographers will not handle, move, or be responsible for letting pets in or out of the property.
Data Retention & Archiving
Hempshall.Co will host the final delivered media on our secure online portal for a period of 3 months from the date of delivery.
It is the booking agent's responsibility to download and back up the media to their own local drives. After 3 months, Hempshall.Co reserves the right to delete the files from our active servers to free up storage space. Hempshall.Co is not liable for the loss of media once the 3-month window has expired.
